Acknowledgement & Acceptance of the Agreement
Welcome to ArabCrunch.NET. ArabCrunch.NET is an online social network for the Arab World, U.S and Europe. The ArabCrunch.NET community is intended for the enjoyment of our members. As a network and a service, ArabCrunch.NET offers links to other websites and is not responsible for the content posted outside of the community.
Members and/or contributors to ArabCrunch.NET are solely responsible for any and all content they contribute to the site. Therefore, ArabCrunch.NET is not responsible for the content of its members or contributors.
Please read the Term of Service very carefully before using or obtaining any Content, services or sites through our website. By accessing the ArabCrunch.NET, and all linked pages owned and operated by ArabCrunch.NET(the "Site"), you agree to be bound by these Terms of Service, as well as any other guidelines, rules and privacy policy.
By joining ArabCrunch.NETyou agree to the following terms and conditions.
Changes to the Agreement or the ArabCrunch.net Services
You agree and understand that these Terms of Service may be updated or modified by ArabCrunch.NET at any time without prior notice, and such modifications will be effective upon ArabCrunch.NET's posting of the new terms and/or upon implementation of the new changes on the ArabCrunch.NET Site. You agree to review the Terms of Service periodically so that you are aware of any modifications. Your continued use of the ArabCrunch.NET site after any modifications indicates your acceptance of the modified Terms of Service. Unless expressly stated otherwise by ArabCrunch.NET, any new features, new services, enhancements or modifications to the ArabCrunch.NET Site implemented after your initial access to the Site shall be subject to these Terms of Service.
Membership Responsibility
If you register to become an ArabCrunch.NET member, you will be allowed to save and personalize ArabCrunch.NETcontent. By becoming an ArabCrunch.NET member, you agree that any registration information you give to ArabCrunch.NET will always be accurate, correct and up to date, (including your first and last name) and you take full responsibility for maintaining the confidentiality of your account user name, password, and all related activity that occurs under your account user name. Accordingly, you understand and agree that you will be liable for any activity performed by any people using your account under your user name and password. You agree to immediately notify ArabCrunch.NET of any unauthorized use of your ArabCrunch.NET account or any other breach of security. If you violate these terms, ArabCrunch.NET may, at its sole discretion, terminate your account, remove or modify any account-related content or access, or take any other action that ArabCrunch.NET believes is appropriate.
Be agreeable at all times. While we understand that people will disagree from time to time on ArabCrunch.NET, we ask that you continue to be agreeable, friendly and avoid looking for arguments or similar behavior. You agree to, at all times, avoid personal attacks on others, and you agree not to use the ArabCrunch.NET tools to send or post threatening or abusive messages to any other person. Do not post blog entries, forums, comments or other content that degrade others on the basis of gender, race, class, ethnicity, national origin, religion, sexual orientation or disability. Abusive language and obscene comments will not be tolerated. Members who we feel to not maintain this level of appropriateness of behavior or conduct may be banned from the site at the discretion of ArabCrunch.NET’s administrators.
User Content Posted on the Site
You understand that all postings, messages, reviews, text, files, images, photos, or other materials ("Content") posted on, transmitted through, or linked from the Site, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for all Content that you post, email or otherwise make available via the Site. You understand that ArabCrunch.NETdoes not control the Content posted by third parties via the ArabCrunch.NET Site, including the content of any messages or comments, and does not guarantee the accuracy, integrity or quality of such Content. Furthermore, the ArabCrunch.NET Site and Content available through the Site may contain links to other websites, which are completely independent of ArabCrunch.NET.
ArabCrunch.NETmakes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will ArabCrunch.net be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content.
Spam
Anyone found using ArabCrunch.NET member databases and/or built-in communications tools for sending "spam" or for unsolicited product or service advertising or promotion will be banned from the site. Spam includes, but is not limited to, chain letters, unsolicited messages or invitations, advertisements or promotions or any communication or solicitation that is prohibited by law or that links to sites of objectionable content. Spammers may be banned from the site at our discretion and information about the spammer may be made available to law enforcement officials if deemed appropriate.
Acceptable Use and Conduct
You understand and agree:
· That no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Site will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain unlawful material;
· That you will only provide Reviews and Content that you believe to be true and you will not purposely provide false or misleading information;
· That the Site may include certain communications from ArabCrunch.NET, such as Site announcements, administrative messages, and that these communications are considered part of ArabCrunch.NET membership and you will not be able to opt out of receiving them;
· That ArabCrunch.NET may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of ArabCrunch.NET violates this Agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. ArabCrunch.NET assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the user submitting any such content. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to ArabCrunch.NET;
· The following is a partial list of the kind of Content and communications that are illegal or not allowed on the ArabCrunch.NET Site. ArabCrunch.NET has the right to investigate and take suitable legal action in its sole discretion against anyone who violates these rules, including without limitation, removing the communication from the ArabCrunch.NET Site and terminating the membership of such violators or blocking your use of the ArabCrunch.NET Site.
You may not post Content that:
• Is unlawful, harmful, threatening, abusive, harassing, tortuous, false, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
• Harasses, degrades, intimidates or is hateful toward an individual or group of individuals;
• Falsely expresses or implies that such Content or material is sponsored or endorsed by ArabCrunch.NET;
• If you are trying to promote another social network, forum or similar web-based community on ArabCrunch.NET, please apply for approval prior to joining the site. You may be immediately banned for soliciting our membership to join another website, forum or social network without prior approval.
• Impersonates any person or entity, including, but not limited to, an ArabCrunch.NET official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Includes personal or identifying information about another person without that person's explicit consent;
• Upload only materials to which you have appropriate intellectual property rights. In general, that means you should avoid uploaded images, videos and audio clips that you have not created or for which you do not have the explicit permission from the creator and/or copyright holder of that intellectual property. You may find that we delete material when we feel it is in violation of this, but you recognize that any material that you contribute to the site in violation of copyright laws is your responsibility.
• Creates, sends, or enables anything that constitutes or contains chain letters, pyramid schemes, or any advertisement that you are prohibited by law from sending;
• Constitutes or contains any form of advertising or solicitation (1) posted in Content; or (2) emailed to Users;
• Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• Do not "cyber-stalk" or otherwise harass other members. Any attempt to intimidate or cause another member fear, anxiety or to coerce them into action will is forbidden. ArabCrunch.net., will take any and all action we deem appropriate to cooperate with law enforcement, attorneys or complainants in the case where harassment and/or stalking are alleged.
Additionally, you agree not to (and you agree not to allow any third party to):
• Use fake names or names of others who are not you;
• Create user accounts by automated means or under false or fraudulent pretenses;
• Stalk or otherwise harass anyone;
• Collect or store data about users for any purpose including for the purposes of advertising to or soliciting any ArabCrunch.NET user to buy or sell any products or Sites;
• Create or transmit unwanted electronic communications such as spam or mass mailings to other users or members of the ArabCrunch.NET Site or otherwise interfere with other user's enjoyment of the ArabCrunch.NET Site;
• Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from ArabCrunch.NET except for Internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org);
• Attempt to gain unauthorized access to ArabCrunch.NET's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of ArabCrunch.NET;
• Use the ArabCrunch.NETSite, intentionally or unintentionally, to violate any applicable local, state, national or international law.
Privacy Policy
We will never share, sell, or trade any of your private or personal information. However, we may provide to law enforcement, at our discretion (or as required by court order) any pertinent information in cases where it appears a law has been broken or a member is suffering any sort of harassment.
ArabCrunch.NET is not responsible for information placed in public view by our members. By default, our homepage is available to the public, and items from your personal page may be featured on the home page either automatically or at the discretion of our administrators. All other pages are hidden from non-members of ArabCrunch.NET. However, as with any website, it is important to consider carefully what personal information you would like in public view.
Agreement to Terms
By applying for membership on ArabCrunch.NETyou agree to our Terms of Service and Privacy Policy. ArabCrunch.NET may update these Terms of Service at anytime. Please read all updates and ensure that you are, at all time, in compliance with these terms.
Limitation of Liability YOUR USE OF THIS WEBSITE IS AT YOUR SOLE RISK. UNDER NO CIRCUMSTANCES, SHALL ARABCRUNCH.NET, ITS OWNERS, OR EMPLOYEES, BE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THIS WEB SITE OR YOUR RELIANCE ON ANY INFORMATION PROVIDED ON THIS WEB SITE. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND WHATSOEVER, WHETHER DIRECT OR INDIRECT, GENERAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LOSS OF DATA.
